Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the SculptDiary Telegram bot, Telegram Mini App, mobile app and related services (the "Service"), operated by Sebastian Bila, a private individual based in Ukraine ("we", "us").

1. Acceptance

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

SculptDiary is a training diary and coaching platform. You can plan and log workouts, track your progress and body data, and work with a coach of your choice.

SculptDiary is not a medical service. Nothing in the Service, from us, from a coach or from an AI feature, is medical advice. Talk to a doctor before starting a new training program, especially if you have a health condition. You exercise at your own risk.

3. Eligibility

You must be at least 16 years old to use the Service.

4. Your account

• Give accurate information and keep it up to date.
• Keep access to your Telegram account and sign-in methods secure. You are responsible for activity under your account.
• Tell us promptly if you believe your account has been used without your permission.

5. Coaches

Coaches are independent users of the Service, not our employees or agents. Each coach is solely responsible for the programs, advice and services they provide, and for any agreement they make with their clients. We are not a party to those agreements and do not guarantee any coach's qualifications or any training results.

6. Subscriptions and payments

• Some features require a paid subscription. Prices and what each plan includes are shown before you pay.
• Platform subscriptions are paid through our payment provider, Tribute, and renew automatically each billing period until you cancel.
• You can cancel at any time. You keep access until the end of the period you have already paid for.
• Payments are non-refundable, except where the law of your country requires a refund.
• Payments for a coach's own plans are made between you and that coach; refunds for them are up to the coach.
• We may change prices. A new price applies from your next billing period, and we will tell you before it does.

7. Your content

You keep ownership of everything you add to the Service, such as workouts, notes, photos and messages. You give us a limited licence to store, process and display that content only as needed to provide the Service, including showing it to a coach you have connected with. You must have the right to share any content you upload.

8. Acceptable use

You must not:

• harass, abuse or impersonate anyone, or post unlawful or offensive content;
• access other users' data without permission, or try to break or bypass the Service's security;
• scrape, copy or resell the Service or its content, or use bots to access it, except through features we provide;
• overload or interfere with the Service, or use it for anything illegal.

9. AI features

Some features use artificial intelligence, for example to turn a voice message into a logged workout or to generate a training plan. AI output can be inaccurate or unsuitable for you. Review it before relying on it.

10. Availability and changes

We work to keep the Service available, but we provide it "as is" and "as available". We may change, suspend or stop any part of it, and it may sometimes be unavailable for maintenance.

11. Termination

You can stop using the Service and delete your account at any time in the app. We may suspend or close an account that breaks these Terms or puts other users or the Service at risk.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect or consequential loss, for loss of data or profit, or for injury resulting from exercise you do. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

13. Governing law

These Terms are governed by the laws of Ukraine, and disputes go to the courts of Ukraine. If you are a consumer, you also keep any protection that the mandatory law of your country of residence gives you.

14. Changes to these Terms

We may update these Terms. We will change the "Last updated" date above, and for significant changes we will notify you in the Service. Continuing to use the Service after a change means you accept the new Terms.
